Resumen
En la comisión de la conducta punible no siempre se da la relación típica de sujeto activo y
sujeto pasivo del delito, sino que existen algunos supuestos en que actúan diferentes
estructuras de poder donde un sujeto utilizando a otro, el cual actúa como instrumento,
comete la acción delictiva; así, cuando se hace un análisis acucioso de los tipos descritos en
el Código Penal Colombiano se observa, como norma general, que las conductas son
realizadas por un sujeto. Sin embargo, desde hace algunos años, por vía de jurisprudencia,
la Corte Suprema de Justicia ha venido desarrollando la posibilidad de juzgar como autores
tanto a quien realizo el hecho como a quien lo ordenó. Lo que supone la implementación
de la teoría de la ―autoría mediata por dominio de la voluntad‖ respecto de los aparatos
organizados de poder y la ―instrumentariedad‖ del ejecutor, debido a que el denominado
―hombre de atrás‖ sabe y cuenta con que sus órdenes van a ser cumplidas.
