Resumen
El derecho fundamental que posee todo ser humano es el de la vida, sin embargo existen circunstancias en las cuales la vida del ser humano se puede ver afectada por condiciones de salud deplorables, que pueden traer como consecuencia una serie de sufrimientos innecesarios y un vida indigna, lo que lleva al dilema de cuestionarse si es más importante el cuidar la vida o evitar la prolongación de la agonía que culmina con la muerte.
¿Es la eutanasia una violación al derecho a la vida?, y en tal caso, ¿Cómo debe proceder el Estado Colombiano?
La eutanasia ha sido un tema que ha generado polémica desde la antigua Grecia, los grandes filósofos como Sócrates, Platón, Aristóteles, Epicuro, hicieron referencia a esta y generaron los primeros debates entre los grupos pro-vida y pro- muerte digna. Más adelante en la edad Media y Renacimiento, se siguieron dando estos debates pero ahora con la intervención del punto de vista de la religión católica y del antropocentrismo. Los debates que hoy en día se generan en los diferentes ámbitos sociales, son el resultado de todos estos acontecimientos históricos que se han apenas mencionado.
En el presente trabajo se tendrán como objetivos el análisis de las implicaciones ético-jurídicas que trae consigo la eutanasia en cuanto a su incidencia en el derecho a la vida, se estudiarán las mismas, se evaluará la existencia o no de la autonomía del ser humano a decidir en los casos en los que no existen opciones médicas de recuperación y lograr la identificación de una posible interrelación entre el derecho a la vida, la dignidad humana, y la buena muerte.
Lo anterior se realizará por medio de la revisión de los antecedentes históricos de la eutanasia y el derecho a la vida, el desarrollo de la eutanasia desde el código penal de 1936 hasta el del año 2000, la realización de un análisis de las implicaciones éticas y jurídicas de los actores que intervienen en ésta, el análisis de jurisprudencia y casos en América y específicamente en Colombia relacionados con este tema, se estudiarán y analizarán los resultados y a partir de estos, se llegará a unas conclusiones.
The fundamental right that every human being possesses is the life, nevertheless there exist circumstances in which the life of the human being may be affected by the deplorable health conditions which can bring as a result a series of unnecessary sufferings and an unworthy life, what it takes to the quandary of questioning if it is more important taking care of the life or avoiding the extension of the agony that culminates with the death.
Is the euthanasia a violation of the right to the life? and in such a case: How must the Colombian State proceed?.
The euthanasia has been a topic that has generated polemic from the ancient Greece, the big philosophers like Sócrates, Platón, Aristotle, Epicuro, they referred to this one and generated the first debates between the groups against and pro - worthy death. Further on in the Average age and Renaissance, these debates kept on giving but now with the intervention of the point of view of the catholic religion and of the anthropocentrism. The debates that nowadays are generated in the different social ambiences, are the result of all these historical events that have been mentioned scarcely.
In the present work will be taken as objective the analysis of the implications ethic-legal that brings with it the euthanasia in terms of its impact on the right to life as a study of the same, will be assessed the existence or not of the autonomy of the human being to decide in the cases in which there are no options for medical recovery and achieve the identification of a possible interaction between the right to life, human dignity, and the good death.
The previous thing will be realized by means of the review of the historical precedents of the euthanasia and the right to life, the development of the euthanasia from the penal code from 1936 to that of the year 2000, the achievement of an analysis of the legal and ethical implications of the actors who are involved in this, the analysis of jurisprudence and cases in America and specifically in Colombia related to this topic, will be study and analyze the results and from these, it will reach some conclusions.
