Resumen
los derechos humanos son universales; promover los derechos humanos consagrados en la declaración universal de los derechos humanos y otras normas internacionales mediante programas de educación, no solo en el ámbito escolar, si no institucional y sobretodo en el ámbito de comunidades vulnerables es una tarea esencial. Los derechos humanos son derechos inherentes al ser humano, los cuales no admiten ninguna discriminación por razón de sexo, edad, condición social, o cualquier otra causa; por ende toda persona goza de la protección de los mismos en el marco jurídico interno y tratados internacionales; y con más razón los derechos humanos de las personas privadas de la libertad, los cuales tienen una protección especial por ser un grupo de mayor vulnerabilidad por la relación de especial sujeción que existe entre el interno y el estado, en este caso representado por el Instituto Nacional Penitenciario y Carcelario (INPEC). En el presente artículo se hace un análisis si ha existido evolución en la protección de derechos humanos de las personas privadas de la libertad en los diferentes establecimientos carcelarios del país; tomando como base los pronunciamientos de la Corte Constitucional, e informes de entidades internacionales dentro del bloque de constitucionalidad y tratados internacionales.
Human rights are universal; Promoting human rights enshrined in the Universal Declaration of Human Rights and other international standards through education programs, not only at the school level, but also at the institutional level and above all in the context of vulnerable communities is an essential task. Human rights are inherent rights to the human being, who do not admit any discrimination on the basis of sex, age, social status, or any other cause; Therefore every person enjoys the protection of the same in the domestic legal framework and international treaties; And with more reason the human rights of persons deprived of liberty, who have special protection because they are a group of greater vulnerability because of the special relationship that exists between the inmate and the state, in this case represented by the Institute National Penitentiary and Prison (INPEC). This article analyzes whether there has been evolution in the protection of the human rights of persons deprived of their liberty in the different prisons in the country; Based on the pronouncements of the Constitutional Court, and reports of international entities within the constitutional block and international treaties.
