Resumen
La mediación es un procedimiento en el cual la participación del tercero neutral que no tiene poder sobre las partes y aporta de manera sustancial a que estas encuentren un acuerdo armonioso para ellas, por lo que las calidades del conciliador no son menos importantes, ya que estas sobresalen en el sistema informal.
• La conciliación como mecanismo alternativo de solución de conflictos presenta ventajas, donde sobresale la rapidez, ya que se puede llegar a una solución en pocas sesiones, siendo más breve que un proceso judicial. Las partes participan activamente, llegando a una solución de forma pacífica, satisfactoria para las partes ya que sin la aprobación de estas no se llegaría a un acuerdo.
• La conciliación se estableció por directriz de la Constitución en el artículo 116, sin embargo la concepción de esta se da bajo los postulados de convivencia, justicia, libertad y la paz, entre otros, pilares del Estado Social de Derecho el cual se basa en la dignidad humana, en el trabajo y la solidaridad de las personas que la integran, por lo que es deber del Estado y de la sociedad fortalecer la convivencia y la consecución de la paz, todos estamos obligados a usar los medios y mecanismos para obtener dicho valor social. • En la conciliación se busca la participación ciudadana como cumplimiento de una finalidad social, que tiene que ver con la calidad de vida de la población, y de manera particular con la solución de necesidades de acceso a la justicia y pronta resolución de controversias, por lo que alcanzar un nivel más eficaz de justicia mediante la solución justa de los conflictos, con la participación activa de las partes, impulsa y contribuye el progreso del país en la paz. • Cada vez son más los centros de conciliación que se encuentran activos para que la ciudadanía en general acuda a estos, con el objetivo de dirimir sus conflictos sin necesidad de acudir a un proceso judicial, esto tiene relación con el aumento de solicitudes de conciliación, las cuales desde la creación de este mecanismo ha aumentado considerablemente. • De acuerdo con las cifras y el resultado en crecimiento, sugiere la aceptación por parte de las personas y la opción de acudir al mismo dado a las numerosas ventajas que se tienen al ejecutarlo. • El desarrollo que se ha tenido jurisprudencialmente tiene un enfoque fuerte en lo relacionado con los requisitos de procedibilidad, en donde la norma que ha sido objeto de demanda de inconstitucionalidad es la Ley 1395 del 2010. • Se tiene un desarrollo normativo diferente de acuerdo con la materia a conciliar sea Civil, Familia, Penal, Administrativo y Laboral, en donde a pesar de concebir la figura de conciliación con el mismo objeto, cada una de ellas presenta particularidades para su ejecución. • El desarrollo de la normatividad ha reforzado poco a poco la figura de Conciliación, en donde busca su legitimidad, celeridad y eficacia, evitando que sea una estrategia dilatoria para las partes.
Mediation is a procedure in which the participation of the neutral third party that has no power over the parties and provides a substantial way for them to find a harmonious agreement for them, so that the qualities of the conciliator are no less important, since they excel in the informal system.
Reconciliation as an alternative dispute resolution mechanism has advantages, where rapidity stands out, since a solution can be reached in a few sessions, being shorter than a judicial process. The parties participate actively, arriving at a solution in a peaceful manner, satisfactory to the parties since without the approval of these parties no agreement would be reached.
The conciliation was established by directive of the Constitution in Article 116, however the conception of this is given under the postulates of coexistence, justice, freedom and peace, among others, pillars of the Social State of Law which is based on the dignity human, in the work and solidarity of the people that make it up, for which it is the duty of the State and society to strengthen coexistence and the achievement of peace, we are all obliged to use the means and mechanisms to obtain this social value
In the conciliation, citizen participation is sought as fulfillment of a social purpose, which has to do with the quality of life of the population, and in particular with the solution of needs for access to justice and prompt resolution of controversies, so that achieving a more effective level of justice through the just resolution of conflicts, with the active participation of the parties, promotes and contributes the country's progress in peace. • There are more and more conciliation centers that are active so that citizens in general go to them, with the aim of resolving their conflicts without having to resort to a judicial process, this is related to the increase in requests for conciliation, which since the creation of this mechanism has increased considerably. • According to the figures and the growing result, it suggests the acceptance by the people and the option of going to the same given the numerous advantages that are had when executing it. • The development that has been jurisprudentially has a strong focus on matters related to procedural requirements, where the rule that has been the subject of unconstitutionality lawsuit is Law 1395 of 2010. • There is a different regulatory development in accordance with the matter to be conciliated is Civil, Family, Criminal, Administrative and Labor, where in spite of conceiving the figure of conciliation with the same object, each of them has particularities for its execution. • The development of regulations has gradually reinforced the figure of Conciliation, where it seeks its legitimacy, speed and efficiency, preventing it from being a delaying strategy for the parties.
