Resumen
En las últimas décadas, el ámbito internacional ha dado una preponderancia a la protección del medio ambiente y de los pueblos indígenas en cuanto a actividades, obras y proyectos de desarrollo que los afectan directamente. Sobre lo anterior, el continente americano no ha sido la excepción debido a que el Sistema Interamericano de Derechos Humanos se ha pronunciado al respecto; sin embargo, no existe claridad en si estas manifestaciones han influenciado a los Estados Miembros de la OEA y en concreto a Bolivia, Chile, Colombia, Costa Rica y México. De allí, que esta investigación tenga un alcance exploratorio- explicativo de tipo cualitativo y bajo el método dogmático y jurisprudencial con los cuales se resolverá este interrogante; con miras a enriquecer el debate que incorpora la protección y promoción del “Derecho Internacional de los Derechos Humanos” en la región y la discusión existente por parte de la comunidad académica, profesional e institucional.
In recent decades, the international arena has given a preponderance to the protection of the environment and indigenous peoples in terms of activities, works and development projects that directly affect them. On the above, the American continent has not been the exception because the inter-American system of human rights has been pronounced in this regard; However, it is not clear whether these manifestations have influenced the Member States of the OAS and specifically Bolivia, Chile, Colombia, Costa Rica and Mexico. Hence, this research has an exploratory-explanatory scope of qualitative type and under the dogmatic and jurisprudential method with which this question will be resolved; With a view to enriching the debate that incorporates the protection and promotion of "human rights law" in the region and the existing discussion on the part of the academic, professional and institutional community.
