Resumen
Este ensayo argumentativo busca comprender la importancia de las guías judiciales como herramienta didáctica útil en la formación profesional de estudiantes de derecho para la celebración de audiencias preliminares ante el Juez de Control de Garantías, partiendo de un paradigma de investigación cualitativo y con fundamento en documentos de corte jurídico y judicial de los últimos cinco años, así como en el contenido de las tres guías judiciales publicadas en Colombia, para lo cual se realizó un análisis estructural, funcional y comparativo. Se acudió también a información estadística y se hizo uso de la estrategia de estudio de casos como apoyo parcial para ejemplificar y contrastar una audiencia realizada adecuadamente con una en la que se omitieron ciertos aspectos relevantes. Lo anterior permitió evidenciar la importancia de enseñarles y ofrecerles desde pregrado a los mencionados estudiantes, el empleo de las referidas guías como apoyo y medio de orientación a su actuación dentro del Sistema Penal Acusatorio y, de esa manera, lograr una mayor eficacia en el desarrollo de las audiencias como es el querer común de toda la sociedad y sin que ello implique su uso obligatorio.
This argumentative essay seeks to understand the importance of judicial guides as a useful didactic tool in the professional training of law students for the celebration of preliminary audiences before the Judge of Control of Guarantees, starting from a paradigm of qualitative investigation and based on documents of legal and judicial court of the last five years, as well as on the content of the three judicial guides published in Colombia, for which a structural, functional and comparative analysis was carried out. Statistical information was also used and the case study strategy was used as partial support to exemplify and contrast a properly conducted audience with one in which certain relevant aspects were omitted. This made it possible to demonstrate the importance of teaching and offering the aforementioned students, from undergraduate level, the use of these guides as support and as a means of orienting their actions within the Accusatory Criminal System and, in this way, achieving greater efficiency in the development of the audiences, as is the common desire of the entire society and without implying their obligatory use.
