Resumen
El Sahara Occidental es una excolonia española ubicada al norte de África, su proceso de descolonización fue concebido mediante acciones ilegales dentro del Derecho Internacional, este hecho permitió la ocupación ilícito de gran parte del territorio por parte de Marruecos, dejando espacio “libre” el cual no se le considera como Estado ante los ojos de la comunidad internacional, la sumatoria de estos hecho ha permitido que se violen distintos Derechos Humanos en dicho territorio, empezando por el de la autodeterminación de los pueblos consagrado en los Pactos de Nueva York, este artículo pretende mostrar por qué en los últimos 20 años la violación de Derechos Humanos en el Sáhara Occidental sigue vigente, esto sustentado en la evidencia histórica de que uno de los factores más influyentes es la ausencia del estatus de Estado del Sahara Occidental.
The Western Sahara is a Spanish ex-colony located in North Africa, its process of decolonization was conceived through illegal actions within International Law, this fact allowed the illegal occupation of a large part of the territory by Morocco, leaving a "free" space which is not considered as a State before the eyes of the international community, the sum of these facts has allowed to violate different Human Rights in that territory, starting with the self-determination of the peoples enshrined in the Covenants of New York, this article aims to show why in the last 20 years the violation of Human Rights in Western Sahara is still happening, this is based on the historical evidence that one of the most influential factors is the absence of the State status of Western Sahara..
