Resumen
El presente artículo, tiene por finalidad hacer un análisis de lo pactado entre el Gobierno de Colombia y el extinto grupo guerrillero de las FARC – EP, el “Acuerdo Final para la Terminación del Conflicto Armado Colombiano y la Construcción de una Paz Estable y Duradera”; haciendo un estudio particular sobre lo acordado en materia de víctimas, con el fin de establecer su sinergia con los lineamientos internacionales y regionales con relación a los derechos de justicia, verdad, reparación y garantías de no repetición. Para lo cual, se desglosará dentro de este documento los siguientes elementos: i) Conceptualización de la justicia transicional, ii) Análisis de casos emblemáticos de justicia transicional en el mundo, iii) Contenido jurídico sobre la justicia transicional y los derechos de las víctimas dentro del Sistema Interamericano de Derechos Humanos, y, por último, iv) Descripción del punto quinto del acuerdo “víctimas” objeto de este estudio en cuanto a garantías de no repetición. Lo que permitirá obtener los insumos necesarios para determinar el cumplimiento por parte del Estado colombiano de las obligaciones regionales en materia de la protección a las víctimas del conflicto.
This article aims to make an analysis of what was agreed between the Government of Colombia and the defunct FARC–EP guerrilla group, the "Final Agreement for the Termination of the Colombian Armed Conflict and the Construction of a Stable and Lasting Peace"; making a particular study on what was agreed on victims, in order to establish their synergy with international and regional guidelines on justice, truth, reparation and guarantees of non-repetition. For this purpose, the following elements would be broken down within this document: (i) Conceptualization of Transitional Justice, (ii) Analysis of Transitional Justice Cases in the World, (iii) Legal Content on Transitional Justice and the Rights of Transitional Justice victims within the Inter-American System of Human Rights, and finally (iv) Description of item five of the agreement under this study. This will enable the necessary inputs to be obtained to determine the Colombian State's compliance with regional obligations in the field of protection of victims of the conflict.
