Resumen
Como primera medida, se partió de de una aproximación histórica al fenómeno en cuestión, donde se observó la evolución de los procesos, como se involucraron las herramientas electrónicas hasta llegar a lo que hoy se conoce como el SECOP. En seguida, se hace el análisis a partir del modelo de contratación denominado licitación pública, se toma este modelo por ser probablemente el ejercicio con mayor nivel de exigencia en cuanto al principio de transparencia se refiere. Teniendo en cuenta que nos encontramos en la era digital y en este punto donde se ubica la investigación posteriormente se realiza un análisis sobre los mecanismos electrónicos y su incidencia en la contratación estatal, determinando que estos, más puntualmente el SECOP han sido desarrollados con el propósito de la no vulneración el principio de publicidad, manteniendo una comunicación acorde con las necesidades de las partes involucradas, propendiendo así por el cumplimiento de los principios de transparencia, economía y responsabilidad. Todo lo anterior se realiza desde la la revisión y análisis de la normatividad y el ejercicio teórico de la contratación estatal. No obstante con el fin de dar una aproximación objetiva a la realidad del fenómeno que nos reúne, como se mencionó al inicio de la presentación se hacen 3 entrevistas, las cuales posibilitaron identificar la percepción que tienen los usuarios del SECOP, y desde su perspectiva identificar las fortalezas y debilidades del Sistema Electrónico de Contratación Pública, que favorecen o desfavorecen los procesos de contratación estatal.
As a first measure, it was based on a historical approach to the phenomenon in question, where the evolution of the processes was observed, as the electronic tools were involved until arriving at what is now known as the SECOP. Next, the analysis is made based on the contracting model called public bidding, this model is taken because it is probably the exercise with the highest level of demand in terms of the principle of transparency. Taking into account that we are in the digital age and at this point where the investigation is located, an analysis is subsequently carried out on the electronic mechanisms and their impact on state contracting, determining that these, more specifically the SECOP have been developed with the purpose of non-violation of the principle of publicity, maintaining communication in accordance with the needs of the parties involved, thus aiming for compliance with the principles of transparency, economy and responsibility. All of the above is done from the review and analysis of the regulations and the theoretical exercise of state contracting. However, in order to give an objective approximation to the reality of the phenomenon that brings us together, as mentioned at the beginning of the presentation, 3 interviews are carried out, which made it possible to identify the perception that users of SECOP have, and from their perspective identify the strengths and weaknesses of the Electronic Public Procurement System, which favor or disfavor state contracting processes.
