Resumen
En el presente artículo de reflexión se analizó la viabilidad de aplicarle a la Fuerza Pública los beneficios de la justicia transicional de la que eventualmente serían favorecidas las FARC-EP ante la posible firma del acuerdo de paz, para cuyos efectos se revisaron algunos aspectos de la justicia transicional y las exigencias en términos de verdad, justicia, reparación y garantías de no repetición, el actual contexto en las conversaciones de paz entre el Gobierno Nacional y las FARC-EP, se revisó el tratamiento jurídico recibido a algunos agentes del Estado en los procesos de paz de Guatemala y El Salvador, y las conductas que descritas como delito en el Estatuto de Roma, para finalizar en la posibilidad jurídica de bridarle a los miembros de las Fuerzas Militares y la Policía Nacional investigados por delitos cometidos en el ejercicio de sus funciones, concluyéndose no solo la viabilidad sino también la necesidad de hacerlo por razones de equidad teniendo en cuenta que han defendido la soberanía Nacional y dispensado seguridad a los habitantes del territorio nacional desde la legalidad, siempre y cuando las investigaciones sean serias y se imponga un mínimo de justicia material alternativa.
In this article reflecting the feasibility of applying the law enforcement benefits of transitional justice would eventually favored the FARC-EP to the possible signing of the peace agreement was analyzed for the effects of some aspects of the reviewed transitional justice and the requirements in terms of truth, justice, reparation and guarantees of non-repetition, the current situation in the peace talks between the National Government and the FARC-EP, the legal treatment received some state agents in the revised peace processes in Guatemala and El Salvador, and behaviors described as a crime under the Rome Statute, to end the legal possibility of bridar members of the Armed Forces and the National Police investigated for crimes committed in the exercise of their functions, concluding not only the viability but also the need to do so for reasons of equity given that defended national sovereignty and security accorded to the inhabitants of the country from the law, as long as the investigations are serious and impose a alternative minimum material justice.
