Resumen
El siguiente artículo busca realizar un análisis de las diferentes sentencias y el resultado de un proceso normativo de enorme interés en el que se pone de manifiesto como pilar constitucional el derecho al agua en Colombia. Al mismo tiempo que se afianza los criterios dentro de los instrumentos internacionales y la existencia del derecho humano al agua, con identidad propia y con contenido definido. En el marco de esta investigación, se analizara que el derecho al agua, es un derecho constitucional complejo que ha sido objeto de progresivo reconocimiento normativo y jurisprudencial a lo largo de los últimos años, en especial, en atención a la importancia que el mismo tiene como presupuesto de los demás derechos fundamentales y de su goce efectivo. Aunque no es una garantía expresamente señalada por la constitución política, se ha de entender incluida, la no mención expresa de un derecho en la constitución, en modo alguno implica que éste no se encuentre considerado, existiendo la obligación estatal de mejorar las condiciones de goce y ejercicio de los derechos económicos, sociales y culturales (Courtis, 2008).
The following text seeks to analyze the different resolutions and the result of a legislative process of great interest in which the right to water in Colombia reveals as a constitutional pillar. At the same time, different criteria reinforce within international instruments and the existence of the human right to water and its own identity strengthen with defined content. In the frame of this research, we will analyze how the right to water is a complex constitutional right that has been subject of a progressive regulatory and jurisprudential recognition over recent years, especially in view of its importance as prerequisite for other fundamental rights and their effective enjoyment. Although it is not a specifically guarantee mentioned in the colombian constitution, it must be understood as included, since the no specific mention of that right in the text of the colombian constitution, in no way implies it will not be considered.
