Resumen
La práctica de la oralidad en la rutina probatoria del proceso penal impone destrezas eficaces y objetivamente evaluadas por el juez sin la dilación que suponen las extensas valoraciones. La percepción del hecho vertido en testimonio, a diferencia las otras clases de pruebas no tiene la ventaja de la permanencia, es tan voluble como la mente humana, está estrechamente ligado a la forma como se fija en la mente en forma de recuerdo expuesto a múltiples influencias que alteran la manifestación verbal del testigo al exponer su versión. Nos ocuparán las formas de percepción de un hecho, los factores subjetivos y externos que pueden afectar la calidad del testimonio y lo haremos desde la óptica del testigo, del hecho, de la norma y desde luego, del interrogador y el juez como elementos activos en la difícil tarea de éste en su papel de impartir un veredicto ajustado a su primario objetivo: la verdad basada en el convencimiento sin asomo de duda que le permitirá fallar. Evitar la merma de la fidelidad a la imagen del hecho en su tránsito desde el hecho mismo por la percepción, la interpretación, los prejuicios, el albedrío y las presiones hasta la expresión en forma de declaración verbal en la audiencia, es el reto de quienes intervienen en el proceso al discernir entre la ocurrencia o no de un hecho.
