Resumen
El propósito del ensayo fue analizar la justicia penal militar aplicada a los miembros de la Policía Nacional, partiendo del principio de igualdad y el status constitucional de civiles, estableciendo diferencias entre lo militar y policial (civil), y situaciones en que un policía asume el rol militar y que justifique ser sujeto de esa jurisdicción especial, así como si realmente la aplicación de esta es una garantía. Metodológicamente es un estudio jurídico de carácter descriptivo de tipo documental y analítico. Los resultados indicaron que constitucionalmente entre lo militar y lo policial hay diferencias, pero el mismo constituyente pone en planos de igualdad lo que en esencia no lo es, sometiendo a los miembros de la Policía Nacional a una justicia militar que no le es propia, pretendiendo justificarlo en las condiciones de orden público y el margen configurativo de carácter legislativo, cuando la verdadera pretensión era obtener obediencia militar de quienes nunca han dejado de ser civiles.
The purpose of the study was to analyze the military justice applied to members of the National Police, on the principle of equality and the constitutional status of civilians, differentiating between military and police (civil), and situations in which a policeman takes justifying military role and be subject to a special tribunal, and if the application of this really is a guarantee. Methodological study is a legal document descriptive and analytical type. The results indicated that constitutionally between the military and the police are differences, but the same constituent puts equality plans which essentially is not, subjecting members of the National Police to military justice that is not their own, pretending conditions justify in law enforcement and legislative configurative margin when the real intention was to obtain military obedience of those who have never ceased to be civilians.
