Resumen
En Colombia se implementa por primera vez un proceso de naturaleza monitoria, cuyo objetivo principal es responder a la elevada cantidad de obligaciones no documentadas a través de un título ejecutivo y que, siendo de poca cuantía, no han podido ser satisfechas o solucionadas de manera ágil a través de los procedimientos hasta ahora consagrados.
El presente trabajo tiene por objetivo hacer una descripción analítica del proceso monitorio acogido en el ordenamiento jurídico procesal con la entrada en vigencia del Código General del Proceso -Ley 1564 de 2012, identificando su naturaleza jurídica, estructura y forma monitoria establecida, con el fin de analizar su implementación, como mecanismo eficiente de solución al problema de los acreedores que no cuentan con un soporte documental para la satisfacción de sus acreencias en el rango de mínima cuantía.
Por otra parte este trabajo, muestra que este proceso busca dar mayor cobertura de acceso a la justicia debido a que su trámite no posee complejidad alguna y podrá ser iniciado sin abogado, es por esto que se proponen los formatos para formular la demanda y su correspondiente contestación.
Finalmente se concluye que nos encontramos frente un proceso y no un procedimiento o trámite como lo llaman en otras legislaciones, esto debido a que el legislador consagró cada una de las partes que debe tener un proceso, es decir, la presentación de la demanda donde se ve reflejado el derecho de acceso a la justicia, la contestación de la misma, ejerciendo aquí el derecho de defensa y contradicción en igualdad de condiciones, así mismo se puede llevar a cabo etapa probatoria si así se hace necesaria, y finalmente la controversia termina con la sentencia dictada por el Juez.
In Colombia, for the first time, a payment proceeding has been created. Its main objective is to attend to an elevated quantity of obligations that are not documented through a collection title and due to their lesser value have not been satisfied or resolved in an effective manner throughout the current established proceedings.
This work´s objective is to present an analytical description of the payment proceeding contemplated in the legal procedural regimen with the execution of the General Proceeding Code – Law 1564 of 2012, identifying its legal nature, structure and its established monitory form, with the aim of analyzing its implementation, as an efficient mechanism to solve the problem of creditors that lack documents to support their claims within the range of proceedings of minimum quantity.
On the other hand this paper shows that the proceeding seeks greater coverage to access justice, because its process does not imply any complexity and can be initiated without a lawyer, it is for this same reason that there are formats to present the lawsuit and also to answer it.
Finally, we conclude that we are before a process and not proceeding a mere as mentioned in other legislation, this is because our legislator established each and every part of a proceeding, meaning the filing of the lawsuit, were is reflect the right to justice access lawsuit respond practicing the right to a defense and contradiction on equal conditions as well as carrying out the evidentiary phase if necessary and finally the dispute ends with a judgment set forth by a Judge.
