Resumen
Las FFMM, en cumplimiento de su misión constitucional tiene el deber de desarrollar operaciones militares orientadas a defender la soberanía, la independencia, la integridad territorial y el orden constitucional, para contribuir a generar un ambiente de paz y seguridad que coadyuve al progreso de la Nación. En este contexto, y ante las reales y potenciales amenazas internas y externas, las FFMM, está facultado para hacer uso legítimo de la fuerza incluso la letal, en procura de defender los intereses supremos de la patria. Pero, estarán preparadas las FFMM para enfrentar futuras eventualidades, ya no en el marco el DIH, sino en el marco de los derechos humanos, en done el uso de la fuerza letal es la última opción? Los nuevos retos exigidos a las FFMM, máxime cuando ya se empiezan a implementar mecanismos de justicia transicional como la ley de víctimas y restitución de tierras (Ley 1448, 2011), plantean la necesidad de hacer un viraje estratégico, cuyo objetivo sea reducir las amenazas a la paz y el orden. De allí es imperativo el planteamiento de parámetros enfocados en el cumplimiento de la misión bajo la perspectiva de los Derechos Humanos, lo cual implica como estrategia, el trabajo coordinado con otras autoridades civiles, judiciales y administrativas.

But the Armed Forces will be prepared to deal with future contingencies, and not under DIH, but in the context of human rights, donate the use of deadly force is the last option. The new challenges required of the Armed Forces, especially when they begin to implement transitional justice mechanisms as the law of victims and land restitution, suggest the need for a strategic shift, which aim to reduce threats to peace and order. Hence it is imperative to approach operational guidelines focused on the fulfillment of the mission from the perspective of human rights, which implies a strategy, coordinated work with other civil authorities, judicial and administrative.
