Abstract
La aparición del sistema penal de tendencia adversarial en Colombia-Ley 906 de 2004- no sólo trasformó el modelo de enjuiciamiento penal, sino que también cambió la forma de pensar de los administradores de justicia, en este punto surgen algunas de sus principales dificultades. La falta de directrices claras sobre la aplicación del nuevo paradigma, ha creado una serie de problemas prácticos para las instituciones judiciales. Este es el caso del control a la acusación, originalmente concebido desde una perspectiva eminentemente formal, directriz que ha tenido un decidido apoyo jurisprudencial y doctrinal. Sin embargo, esta tendencia debe ser reevaluada con el fin de permitir a los jueces un papel más activo en la determinación sobre la viabilidad de la acusación. Así las cosas, con el fin de conservar la imparcialidad judicial debe haber un juez que supervise el proceso, mientras que otro escucha y decide el fondo de la cuestión, como se argumenta en este trabajo. El mecanismo también implica la adopción de una etapa intermedia en el proceso penal. Así mismo, los cambios propuestos deben ser implementados a través de la reforma legislativa del Código de Procedimiento Penal vigente.
The emergence of the penal system with adversarial tendencies in Colombia-Law 906 of 2004- became not only the current model of inquisitorial criminal prosecution, but also changed the way of thinking of justice administrators. This is where the implementation of the system had, and still has, its main difficulties. The lack of clear guidelines concerning the implementation of the new model created a number of practical challenges for judicial institutions, including in criminal prosecution cases. The shift from a system that only required written motions and in which judges and criminal defendants never faced one another in person, created a new set of challenges for the judicial system. However, this trend of jurisprudence must be reassessed for the purpose of allowing judges a more active role in determining the viability of the prosecution’s case. In order to retain judicial impartiality there should be a judge overseeing the proceedings while another hears the merits of the case, as argued in this paper. This mechanism also involves the adoption of an intermediate stage in the criminal process. These proposed changes should be implemented through legislative reform of the current criminal procedure code.
