Abstract
Este artículo pretende demostrar que hacer obligatorio el recurso de apelación en sede administrativa, es nugatorio para los intereses del administrado, porque vulnera las disposiciones constitucionales como el debido proceso y el acceso a la administración de justicia.
No obstante, la decisión final de aplicar o no la Ley 1437 de 2011, artículo 76, por encima de la constitución, estriba en cabeza del juez, inferencia a la que se llegó luego de realizar un estudio de este derecho a través de la historia, la ley y las dos doctrinas yuxtapuestas mencionadas en el cuerpo del trabajo.
This article seeks to show that make mandatory the appeal in governmental entities, it is nugatory to the interests of people, because it breaks constitutional provisions such as due process and access to justice.
However, the final decision to apply or not the Law 1437 of 2011, Article 76, above the constitution, it is up to the judge, inference which came after making a study of this right through history, the law and the two juxtaposed doctrines mentioned in text content.
