Resumen
Según lo enunciado por la honorable corte constitucional en sentencia t-177/2012, y tomando como base las deficiencias de tipo factico en que incurren algunas providencias judiciales, sobretodo en vigencia de la Ley 600 de 2.000 donde se dictaron un innumerable número de condenas contra personas que nunca fueron identificadas plenamente y luego de ser consultados sus antecedentes, se enteraban que habían sido procesados y condenados, sin ni siquiera vivir en el lugar de los hechos, pero que por situaciones del destino habían perdido su documento de identidad, siendo utilizado por malhechores, que finalmente eran condenados por el Estado, fruto de homónimia y suplantaciones de identidad, debido a que el juez ya sea por un rápido actuar decide fallar precipitadamente, sin esperar un resultado que por ley se le atribuye a la Fiscalía General de la Nación y a la Policía Judicial, quien tiene la función de identificar “plenamente” al Procesado, situación que trata de ser subsanada por el Sistema Penal Acusatorio al consagrar entre otras normas, el art 128 Ley 906 de 2004, modificado por el art 90 ley 1453 de 2011 y art 302 ley 906 de 2004 modificado por el art 22 de la ley 1142 de 2007, por lo que se hace imperiosa la necesidad de poner en marcha las herramientas que aportan los sistemas de identificación con que cuenta la Policía Judicial en Colombia, a fin de evitar que las autoridades penales, sigan incurriendo en estos errores y eviten un correcto actuar de la Justicia, es por esto que a partir de los avances tecnológicos, toma gran importancia la aplicación de sistemas biométricos de identificación que faciliten en términos de eficacia y eficiencia, efectuar una rápida verificación de identidad de los procesados.
As stated by the honorable constitutional court ruling T-177/2012, and based on factual deficiencies kind incurred some judicial decisions, especially in enforcement of Law 600 of 2000 where an innumerable number of sentences were issued against people who were never fully identified and then be consulted their background, they learned they had been tried and sentenced, without even live in the scene, but for situations of fate had lost their identity, being used by criminals, which eventually were convicted by the State, the result of homonyms and identity theft because the judge either by rapid action decides fail abruptly, without waiting for a result which by law is credited to the Attorney General's Office and the Judicial Police, who has the task of identifying "fully" to Processed, is situation be remedied by the accusatory penal system enshrines among other rules, Article 128 law 906 of 2004, as amended by Article 90 of law 1453 Act 2011 and Article 302 906 2004 amended by section 22 of Act 1142 of 2007, so it is imperative to implement the tools provided identification systems available to the Judicial Police in Colombia, to avoid criminal authorities continue to incur these errors and prevent proper act of justice, that is why from technological advances, making important application of biometric identification systems to provide in terms of efficiency and efficiency, make a quick check of identity of the accused.
