Resumen
El Régimen de Contratación Estatal obliga a las Entidades Públicas a adelantar sus procesos contractuales con base a procesos competitivos, plurales y sobre todo respetando la aplicación del Principio de Transparencia en cada actuación de la administración, por tal razón el eje principal bajo el cual el Estado debe encaminar sus procesos es la Transparencia. Este trabajo de grado abordara el estudio del Principio de Transparencia desde la perspectiva de la evolución que ha tenido esta figura en el régimen de contratación estatal, haciendo un análisis normativo, jurisprudencial y doctrinal del mismo, reconociendo el avance que el estado Colombiano ha integrado en su normatividad, pero confrontándolo con un tipo de reglamentación especial de contratos con Entidades sin Ánimo de Lucro que contraria los fundamentos del Principio de Transparencia. Finalmente, se realizaran unas recomendaciones fruto de los avances que ha evidenciado el Régimen de Contratación Estatal en temas de transparencia y que permitirán evitar prácticas excepcionales que desvirtúen el principio de transparencia.
Continuous changes in the Public Procurement System in Colombia have caused both public and private entities to have little clarity about the current standards, procedures and applicable guidelines. This causes legal practitioners to make errors and also causes the possibility of having verdicts against the state because of these errors. Therefore, this thesis is intended to encompass the study of major regulatory changes and procedures in public procurement and how a consolidated Public Procurement and Contract System was built from a compendium of rules that formerly governed the matter but without any coordination among them. This study starts by analyzing the historical evolution that this system has had since 1991 to date, and continues by detailing the different modalities and procurement processes as well as major changes from the previous regulations. It highlights the flaws and the gaps existing in this process, addressing this issue from the jurisprudential point of view and other main pronouncements of the courts. The authors believe that this study should not be delayed further in time and that it will be helpful to create legal certainty and to know deeper how the status of the Public Procurement System currently is. This study may also help to answer the question about if after the issuance of Decree 1510 of 2013 and the creation of the National Agency for Public Procurement called 'Colombia Compra Eficiente', this Colombian Public Procurement System could be considered as a truly articulated system for purchases.
