Abstract
Las facultades jurisdiccionales otorgadas a la Superintendencia Financiera, área de defensa al consumidor financiero, buscan la celeridad en los procesos, pretendiendo descongestionar los juzgados y dejando en cabeza de personas con verdadero conocimiento en el tema, garanticen una real y efectiva aplicabilidad de los derechos otorgados a los ciudadanos. Pero ¿ha sido efectiva esta decisión? esto es lo que se busca descifrar dentro del presente ensayo mediante un trabajo de campo con algunas muestras de las decisiones adoptadas con la Delegada para funciones jurisdiccionales de la SFC presentadas durante el primer semestre de 2013, para ello se empleó un enfoque cuantitativo con un método inductivo donde se conocieron varias sentencias de la citada entidad y en donde en su mayoría materializaron el derecho y se ordenó a los prestadores de bienes y servicios que fueron condenados, la restitución del objeto de las pretensiones
