Resumen
La inexistencia de una política adecuada en el manejo de tierras en el departamento de La Guajira, por parte de instituciones locales y nacionales, durante más de treinta años generó una tragedia humanitaria en la nación Wayúu. El avance de empresas multinacionales, en su afán por acceder a la riqueza carbonífera que yacía bajo el suelo de esta comunidad, junto con la ineficiencia estatal y, en ocasiones, la ignorancia inicial de los funcionarios oficiales y de los empresarios, acerca de la cultura y cosmovisión Wayúu, generaron graves violaciones a los derechos humanos de los indígenas.
The lack of an appropriate policy on land management in the department of La Guajira, by local and national institutions, for over thirty years led to humanitarian tragedy in the Wayúu nation. The advance of multinational companies, in their quest to access the coal wealth that layed beneath the floor of this community, along with state inefficiency and, sometimes, the initial ignorance of government officials and businessmen, about culture Wayúu, generated serious violations of human rights of indigenous people. The Colombian justice has issued some rulings, isolated, have not achieved the necessary to compensate the damage impact. Many local complaints related to the violation of human rights of this ethnic group have not yielded any concrete results. Instances of international justice and the Inter-American Court of Human Rights, have issued statements to the Colombian State requested precautionary Wayúu leaders and female leaders that in fact, look for justice for the abuses suffered. In this perspective, it is not excluded that non governmental organizations, civil society organizations and the communities demand an intervention of international justice, against the ineffectiveness of internal justice in Colombia.
