Abstract: El trabajo pretende analizar si las facultades sancionatorias del Procurador al momento de imponer sanciones de inhabilidad a funcionarios electos por votación popular, vulneran los preceptos constitucionales a la libertad política y al debido proceso, ahora bien es de aclarar que en el ordenamiento jurídico colombiano la facultad del Procurador es legal y constitucional, teniendo en cuenta que en reiteradas jurisprudencias la Corte ha expresado que no hay violación a la norma en las investigaciones disciplinarias que adelante el ente de control, situación que ha generado una serie de pronunciamientos por parte de juristas y académicos, donde algunos de ellos expresan que dicha facultad es violatoria a la Convención Americana de Derechos Humanos al confirmar que es competencia de un juez penal, inhabilitar a un funcionario público de elección popular y no de la Procuraduría General de la Nación como una autoridad administrativa. El trabajo se adelantó utilizando las técnicas descriptivas junto con la práctica explicativa que enfocara las posturas o pronunciamientos frente al problema planteado dentro del aludido texto académico, si bien es cierto que dicha facultad es constitucional se hace necesario que el congreso y la Corte Constitucional en su jurisprudencia puedan limitar un poco la facultad sancionatoria del ente de control, teniendo en cuenta los principios constitucionales de un estado social de derecho, razón por la cual es indispensable que esta facultad tenga un límite bien sea legal o jurisprudencial.
Abstract: The paper is intended to analyze, whether the sanctioning faculties of the procurator at the time of imposing sanctions of inability to elected officials by popular vote, violate the constitutional precepts to liberty and the due process, well now, it is to clarify that in the Colombian domestic legal system, the faculty of the procurator is legal and constitutional, taking into account, that in several Court jurisprudences he has expressed, that there is not violation to the rule in the disciplinary investigations being advanced by the control entity. Situation that has generated a series of statements by the jurists and scholars, in which some of them express such faculty as the violation to the American Convention on Human Rights, by confirming that is a competence of a penal judge, to disqualify a public official from the popular election, and not of the Procurator-General of the Nation as administrative authority. The work was advanced using descriptive techniques, together with the explanatory practice, that will focus the positions and statements addressing the stated problem within the alluded academic text, well now, while it is true that this power is constitutional, it is necessary that the congress and the constitutional court in their jurisprudence, can limit somewhat the sanctioning faculty from the control entity, taking into account the constitutional principles of the social rule of law, the reason why is essential that this faculty has a limit, either legal or jurisprudential.
