Abstract
La liquidación de los contratos estatales es una obligación legal que parte de la necesidad de formalizar el cierre o terminación de las obligaciones mutuas derivadas de la ejecución de un contrato. Tal como lo estipula la norma es el documento donde constarán los acuerdos, conciliaciones y transacciones a que llegaren las partes para poner fin a las divergencias presentadas y poder declararse a paz y salvo. En ese sentido la entidad deberá liquidar mediante cualquiera de las formas previstas para ello, tales como la liquidación bilateral, liquidación unilateral o liquidación judicial dependiendo de la situación en la que se encuentre la entidad. Con el presente documento se pretende analizar que la terminación de la relación contractual o la extinción del vínculo a través de la liquidación, no niega el nacimiento de las obligaciones que en el futuro deban ser asumidas por el ex contratista, obligaciones post-contractuales que se deben asumir y de las cuales se debe dejar constancia en la liquidación, y que son diferentes a las obligaciones que se adquieren dentro de la ejecución contractual, pues estas ya se habrán cumplido.
