Resumen
En el desarrollo de las operaciones militares nos encontramos que éstas se pueden realizar en el marco de
dos grandes ordenamientos: 1. DERECHO INTERNACIONAL HUMANITARIO y 2. DERECHOS HUMANOS.
Para lo anterior, se han establecido unas REGLAS DE ENCUENTRO las cuales generan los parámetros para
el enfrentamiento armado, ya sea en el marco de unas REGLAS DE ENFRENTAMIENTO PARA EL
COMBATE TERRESTRE (DIH) o REGLAS DE USO DE LA FUERZA PARA LA CONDUCCION DE
OPERACIONES TERRESTRES DE MANTENIMIENTO DE LA SEGURIDAD (DDHH). Al desencadenar
dichas operaciones en cualquiera de los escenarios presentados, en un resultado operacional (MUERTE EN
COMBATE) se da inicio a investigaciones de índole penal, disciplinarias y/o administrativas. En el presente
documento se hacen una serie de recomendaciones de como adelantar las investigaciones disciplinarias,
teniendo en cuenta el marco aplicable al evento presentado, ya que las pruebas decretadas quedarán al libre
albedrío del fallador siempre que las mismas sean conducentes y pertinentes. Para las investigaciones en un
hecho ocurrido a las luces del Derecho Internacional Humanitario, deberá verificarse la aplicación de los
principios de la guerra (Distinción, limitación, proporcionalidad, humanidad y necesidad Militar, siendo éste
último el que permite el uso proporcionado de la fuerza durante un conflicto armado, para lograr que el
enemigo se rinda), mientras que si se esta frente a un hecho en el campo de los Derechos Humanos, se
deberá demostrar que se estaba actuando amparado bajo una causal eximente de responsabilidad.
