Resumen
El estado tiene con los Derechos Humanos de sus asociados, las preponderantes obligaciones de respeto y
garantía, compromisos que se materializan en una gran proporción en el actuar legítimo de sus Fuerzas
Militares, que a su vez no podrían existir sin una eficiente administración de justicia; en un conflicto armado de carácter no internacional donde el adversario ha decidido servirse de la sociedad civil para evitar la acción del estado, el personal militar podría generar daños y perjuicios a la comunidad, en desarrollo de la misión constitucional. La responsabilidad del Comandante militar se materializa entonces, en la emisión a sus subalternos de políticas claras y concretas con respecto al respeto a los Derechos Humanos y a la aplicación del Derechos Internacional Humanitario y garantizar el conocimiento por parte los mismos. Empero, existen circunstancias de la guerra que generan un factor de imprevisibilidad en la conducta de los subalternos, y los aleja del cumplimiento del objetivo principal. Y aunque pudiera convertirse ello en una causal de exclusión de responsabilidad del Comandante, con el argumento de la responsabilidad perenne que se exige a los mismos, se emiten juicios de reproche que pudieran rayar con la impunidad y la injusticia.
