Resumen
El control material de la acusación es un mecanismo existente dentro de los dos grandes sistemas de procedimiento penal en el mundo, siendo uno de sus propósitos limitar el poder de la fiscalía, dando ventajas como la de garantizar el principio de presunción de inocencia y de llevar a juicio causas probables. Pese a esto la ley 1407 de 2010 que implementó el Sistema Acusatorio Adversarial en la Justicia Penal Militar, no le observó. El siguiente artículo resalta la importancia del control material de la acusación para la jurisdicción castrense, sus orígenes y la conjunción al principio de legalidad y reforma. Para lo cual se hizo una comparación del actual Sistema Penal Ordinario con el de la Justicia Penal Militar de Corte Inquisitiva actualmente en uso y con el sistema que manejan algunos tribunales internacionales como lo es la Corte Penal Internacional, para concluir con la verificación de si dicho control existe o no.
Accusation´s material control is a mechanism present on the two biggest systems of criminal procedure in the world; its main goal is to limit prosecutor power, giving benefits as guarantee the presumption of innocence principle and taking trials with probable reasons to judgment. However, the act 1407 of 2010, which implemented the adversarial system in the criminal military justice, did not take it into account. This article highlights the importance of the accusation´s material control for the military jurisdiction, its origins and its relation with the principle of legality and reform. For that reason, it makes a comparison between the current Criminal Ordinary System, the Criminal Military Justice which has an inquisitorial model and the system that some international tribunals use like the International Criminal Court. Finally, it cheeks whether these systems include the material control or not.
