Resumen
El sistema penal vigente en Colombia, ha dado especial importancia a las víctimas
de una conducta punible, en desarrollo del proceso penal, desde la fase
investigativa hasta la sentencia que pone el punto final a la actuación judicial, y
que necesariamente debe incluir la reparación integral a las víctimas como
elemento principal de la justicia restaurativa. Por ello esté escrito pretende
determinar, acorde a la práctica en el litigio y la realidad Colombiana, que sucede
con los preacuerdos cuando el operador judicial, en su afán de obtener una
terminación anticipada del proceso, o no garantiza los derechos de las víctimas,
incurriendo en conductas que posteriormente no son aprobadas por el juez, bien
de garantías o de conocimiento. Dar respuesta de algunas de estas situaciones
mediante el análisis que se desarrolla este escrito, con el que se pretende prevenir
a las víctimas, estudiantes y futuros operadores judiciales, para buscar minimizar
ese riesgo y de esta manera contribuir a seguir logrando el objetivo de la ley
906 de 2004, como es obtener una justicia pronta, restaurativa, y sobre todo
descongestionar los despachos judiciales, para lo cual los preacuerdos y la
negociación son un instrumento esencial que sin duda ayudará eficazmente a
que se logre este reto en nuestra justicia penal.
The current criminal justice system in Colombia, has given special importance to
the victims of a punishable conduct in the criminal justice process development,
from the research stage to the sentence which sets the final point of the
prosecution, and which must include integral compensation to the victims as a
main element of restorative justice. Due to these points, this article, based on the
litigation practice and the Colombian reality, aims to understand what happens with
the preliminary agreements when the judicial operator, in her quest to obtain an
early end for the process, incurs in conducts which could not be approved by a
guarantee or a trial judge. This article aims to solve some of these situations
through the analysis used here, one which could prevent victims, students and
future judicator operators to minimize that risk and at the same time contribute to
the goal of the law 906 of 2004 (a.k.a. promt justice, restorative, and most
importantly decongest the judicial offices). In which the preliminary agreements
and the negotiation are an essential tool and with no doubt will help achieve this
challenge efficiently in our criminal justice system
