Abstract
El presente ensayo busca demostrar la importancia de uno de los elementos probatorios más antiguos y más importantes en el desarrollo de un proceso penal; se evidencia en los diferentes autores que relaciono en este ensayo, que con el desarrollo de un testimonio se puede determinar la responsabilidad que existe por parte de un procesado; con el testimonio se busca que tanto la víctima como los testigos de un hecho ilícito relaten las circunstancias de tiempo, modo y lugar en la que se presentaron los mismos, es decir representar al juez de manera detallada la forma cómo sucedieron los hechos, por ello se procedió a determinar quienes pueden ser testigos, como se puede emplear el testimonio dentro de un proceso penal, y que valoración se le debe otorgar al testimonio al momento de tomar una decisión aun cuando este sea el único medio probatorio con el que se adelante la investigación.
This essay seeks to demonstrate the importance of one of the oldest and most important in the development of criminal prosecution evidence ; It evidenced by the various authors who relate in this trial , that with the development of a witness can determine the responsibility that exists by a processing ; the testimony is intended that both the victim and witnesses of wrongful recount the circumstances of time , manner and place in which they were presented , ie represent the judge in detail the way in which the incident occurred , why proceeded to determine who may be witnesses , as you can use the testimony in criminal proceedings and that valuation should be granted to the testimony when making a decision even if this is the only form of evidence with which forward the investigation.
