Resumen
Este artículo trata de la protección del derecho a la impugnación en relación con el principio de doble instancia, su surgimiento histórico y las normas que lo contemplan a nivel internacional y en la legislación colombiana. Esta última considera es por medio del recurso de apelación que se protege este derecho fundamental, de allí se analiza si dentro de las disposiciones internas se cumplen con los requisitos expuestos por la Corte Interamericana de Derechos Humanos para ser el recurso adecuado y efectivo. Concluyendo que la Corte Constitucional a través de su jurisprudencia al referirse a la apelación ha tenido en cuenta estas características pero que en su último pronunciamiento considero que existen casos donde hay una omisión legislativa para dar cumplimiento al derecho de impugnación.
This article will analyze the protection of the rigth to complain relate to the principle of second hearing its historical emergence; and the internacional law and the colombian law that established them. The latter is considered by the appeal this fundamental right is protected, from there analyzes if within the domestical provisions they are compatible with the requirement of the Inter-American Court of Human Rights to be an adequate and effective resource. Concluding that the Constitutional Court through its jurisprudence it has taken into account this these characteristics abaut appeal; whereas in its last pronouncing considers that exist cases where there is a legislative omission to comply with the right of appeal.
