Abstract
El Marco Jurídico para la paz surge como una manifestación del fenómeno jurídico conocido como “la Constitucionalización del Derecho” la cual reviste de gran trascendencia en el contexto nacional actual, pues ante el entusiasmo de unos y el escepticismo de otros, la academia ha de mostrar posturas realistas, que permitan tener una visión y lecturas claras de lo que se avecina para el futuro de la Nación.
Partiendo de concepciones de derecho antagónicas, el derecho penal clásico y a su vez, el derecho constitucional, lograron sincretizarse en uno solo, el derecho penal constitucionalizado, donde a través del método analítico descriptivo, se pretende describir instituciones del derecho en referencia, evidenciando así el carácter especialísimo que ostenta una figura jurídica tan novedosa y controvertida como lo es el “Marco Jurídico para la Paz”.
