Abstract
Frente al delito de deserción cometido por miembros de la Fuerza Pública que prestan su servicio militar obligatorio en Colombia, y de acuerdo a lo contemplado en el artículo 89 de la Ley 522 de 1999 y artículo 76 de la Ley 1407 de 2010, cuál es el término establecido para materializar el fenómeno de la prescripción? Esta respuesta considera una importante propuesta frente al trabajo de investigación, ya que para los funcionarios que administran justicia penal militar es inherente el conocimiento no solo legal, sino que por vía de doctrina y jurisprudencia es necesario conocer y aplicar, más aún cuando al momento de ejercitar la toma de decisiones en esta jurisdicción existe disparidad y falta de unificación al momento de resolver situación jurídica al sindicado, calificar el mérito sumarial o proferir la sentencia en primera instancia frente a este fenómeno. Por vía de jurisprudencia y en análisis de la doctrina correspondiente se habrá de resolver esta incertidumbre jurídica, y como resultado de ello entonces es preciso establecer que para el delito de deserción cometido a partir del día 17 de agosto de 2010 se tendrá como término prescriptivo un término de dos (02) años.
Faced with the crime of desertion committed by members of the Public Force that provide their military service in Colombia, and in accordance with what is contemplated in article 89 of Law 522 of 1999 and article 76 of Law 1407 of 2010, what is the Term established to materialize the phenomenon of prescription? This response considers an important proposal in relation to the research work, since for officials who administer military criminal justice, not only legal knowledge is inherent, but through doctrine and jurisprudence it is necessary to know and apply, especially when, at the time of Exercising decision-making in this jurisdiction there is disparity and lack of unification when resolving the legal situation of the syndicate, qualify the summary merit or deliver the sentence in the first instance against this phenomenon. By means of jurisprudence and in analysis of the corresponding doctrine, this juridical uncertainty will have to be solved, and as a result, it is necessary to establish that for the offense of desertion committed as of August 17, 2010, a prescriptive Term of two (02) years.
