Resumen
El artículo 163 de la Ley 1801 de 2016, por la cual se expide el Código Nacional de Policía, otorga a los uniformados de policía la potestad de ingresar al domicilio cuando sea de imperiosa necesidad y sólo cuando se presenten uno de los seis eventos que se describen en el artículo. En este ensayo, que busca analizar detalladamente si la mencionada norma vulnera el derecho fundamental a la intimidad, se utilizó la metodología dogmática y el método de hermenéutica de primer y segundo nivel. Se analiza detalladamente el alcance del derecho a la intimidad y sus límites, en contraposición con los hechos que permiten el ingreso del uniformado de policía al domicilio sin orden escrita.
Como resultados de este análisis encontramos que el alcance del derecho a la intimidad se extiende a las relaciones de convivencia de las personas y al lugar donde se dan; también que el derecho a la intimidad tiene como limites la protección de la seguridad nacional, del orden, salud y moralidad pública y de los derechos y libertades de los demás individuos; así mismo, que existen otros derechos fundamentales y constitucionales que priman sobre el derecho a la intimidad como son el derecho a la vida, la integridad y la seguridad.
The 163th article of Law 1801 of 2016 whereby the National’s Police’s Code gives to police body the supremacy to go in the home address when it is absolutely necessary be in the article, and only when this present one this six events described. This essay is about to evaluate in detail where the selectioned law violates the fundamental right to privacy. For that, we chose to use the dogmatic methodology and the hermeneutics’ method has been used whereby the right is detailed analyzed to privacy and their scope is used to opposite to the facts that allow the entry of uniformed police at home without a warrant.
As consequence of this investigation we found that the scope of the right to privacy extends to the relations of coexistence of the peoples and the place where they occur; also that the limits of the right to privacy are the protection of national security, public order, public health, public morality and rights and liberties of everyone; Likewise, there are other fundamental and constitutional rights take precedence over the right to privacy as the right to life, integrity and security.
