Resumen
Después de siete décadas de la ratificación del tratado Esguerra-Barcenas, Nicaragua demandó a Colombia ante la Corte Internacional de Justicia, para reclamar no solo una línea de delimitación marítima bajo el principio de la equidad, si no también soberanía sobre un territorio colombiano estratégicamente ubicado en el Caribe, lugar de importantes recursos y biodiversidad. El ensayo tiene como propósito determinar los intereses geoeconómicos y geoestratégicos de la Republica de Nicaragua en este territorio, que la llevaron a establecer la demanda ante la Corte, así mismo, mediante el método cualitativo descriptivo y desde una perspectiva imparcial, se analizan brevemente los efectos positivos o negativos de dichos intereses en temas de importancia geopolítica, como la economía, la seguridad internacional, y el medio ambiente, lo anterior en el contexto del litigio ante la Corte y el fallo del 19 de noviembre de 2012.
After seven decades of Esguerra-Barcenas treaty ratification , Nicaragua sued Colombia before the International Court of Justice, to claim not only a maritime delimitation line under the principle of equity, also sovereignty over a colombian territory strategically located in the Caribbean, place of important natural resources and biodiversity. This essay is intended to determine the geo-economic and geo-strategic interests of the Republic of Nicaragua in this territory, which led to claim before the Court, as well, through the descriptive and qualitative research from an unbiased or neutral perspective, are briefly discussed the positive or negative effects of such interests in issues of geopolitical importance, such as the economy, international security, and the environment, in the context of the litigation at the Court and the judgment of November 19-2012.
