Resumen
El ensayo que se postula se centra en la causal séptima de preclusión prevista en el artículo 294 del C.P.P o preclusión por vencimiento de términos, por tanto, el objetivo principal será determinar si el juez de conocimiento en el trámite de la preclusión cuando está amparada en esta causal, únicamente tiene la facultad de decretar su aprobación al verificar el cumplimiento de un requisito objetivo, conforme lo establece la Ley, o verificar un requisito de carácter subjetivo según lo indica la jurisprudencia.
De manera subsiguiente, se hará un análisis de las facultades del Juez en el trámite de la preclusión, se revisará la jurisprudencia y doctrina nacional acerca de la causal séptima de preclusión y la relación entre la figura del vencimiento de términos y los postulados de los derechos y garantías mínimas del procesado y los proposiciones de los derechos de las víctimas.
Para estas actividades se hará uso de la consulta amplia y profunda de los desarrollos jurisprudenciales al respecto, por un lado, y de la postura de varios autores, por otro lado. De este modo, no se limitará a una actividad meramente descriptiva o de resumen de tales consultas, sino que se procesará la información de manera deductiva para redundar en posiciones claras en apoyo a la hipótesis o en conclusiones que motiven desvirtuar la hipótesis. Por tanto, el enfoque metodológico será hermenéutico de primer y segundo nivel.

For these activities will make use of the breadth and depth of consultation about jurisprudential developments on the one hand, and the position of various authors, on the other hand. Thus, it is not limited to a purely descriptive activity or summary of such consultations, but deductively information to lead to clear positions in support of the hypothesis or conclusions that motivate disprove the hypothesis will be processed. Therefore, the methodological approach is hermeneutical first and second level.
