Resumen
En las dos últimas décadas, ha venido trascendiendo, la colisión de Competencia, ante Consejo Superior de la judicatura; entre la Justicia Ordinaria y la Justicia penal militar, para llevar a los estrados judiciales Ordinarios; a los miembros de las FFMM, por presuntos hechos punibles, sucedidos dentro del servicio, y en cumplimiento del deber constitucional y la Ley. Por consiguiente se efectuará un análisis de la justicia penal Militar, en la actualidad y los diferentes cambios Jurisprudenciales; que se han venido dando, para dilucidar en parte la problemática, que se presenta; entre las dos jurisdicciones (Jurisdicción Ordinaria y Penal Militar); siendo necesario, hacer una investigación, utilizando una metodología deductiva e interpretativa del Derecho, guiada mediante un análisis Jurisprudencial. Y así, poder obtener un resultado más objetivo, presentando una recomendación acertada y más cercana a la realidad; ofreciendo una posible solución a las necesidades, resultante de las dificultades, que se presentan en la actualidad; instituciones judiciales, sobre los posibles errores que se están cometiendo, las cuales afectan el entorno y la seguridad.
In the last two decades, there has been widespread, the collision of Competition, before Superior Council of the Judiciary; between the ordinary courts and the military criminal justice, to bring the ordinaries courtrooms; members of the armed forces for alleged punishable occurred within the service, and in compliance with the constitutional duty and the law.
Because of this, an analysis of criminal justice Military, today and different jurisprudence changes will be made; that have been taking place, partly to elucidate the problem, which occurs; between the two jurisdictions (Ordinary and Military Criminal Jurisdiction); being necessary, do research, using a deductive and interpretive methodology of law, guided by a jurisprudential analysis. Thus, to obtain a more objective result to present an accurate and closer to reality recommendation; providing a possible solution to the needs resulting from the difficulties presented today; judicial institutions, on possible errors being committed, which affect the environment and public safety.
