Abstract: El presente Artículo se basa en una investigación desarrollada con base en el tema de In Dubio Pro Jurisdicción, partiendo de los lineamientos que argumentan la funcionalidad y la trascendencia legal en los procesos a que hacen referencia tanto la constitución política como la ley 270 de 1996, los cuales, atribuyen al Consejo Superior de Judicatura, sala disciplinaria la función de dirimir los conflictos de competencia que se susciten entre las distintas Jurisdicciones, a fin de establecer a través de avances legales y jurisprudenciales, la manera de recuperar en su integridad el Fuero Penal Militar. Partiendo del conflicto de competencia entre la Justicia penal militar y la justicia ordinaria, en cuya situación; siempre la especializada pierde la competencia y cuyos objetivos de la investigación se plantean a partir del Análisis del factor determinante para dirimir el conflicto de competencia entre la justicia penal y justicia penal militar.
Abstract: The present article is based on a research developed based on the theme of In Dubio Pro Jurisdiction, starting from the lines that argue the functionality and the legal importance in the processes that reference both the political constitution and like law 270 of 1996 , Which attribute to the Superior Council of Judicature, the disciplinary chamber the function of settling the conflicts of jurisdiction that arise between the different Jurisdictions, in order to establish through legal and jurisprudential advances, the way to recover in its entirety the Military Criminal Court. Starting from the conflict of jurisdiction between the military criminal justice and ordinary justice, in whose situation; Always the specialized one loses the competition and whose objectives of the investigation are raised from the Analysis of the determinant factor to settle the conflict of competition between the criminal justice and military criminal justice.
