Resumen
Este artículo estudia las relaciones surgidas al interior del proceso penal entre los preacuerdos y negociaciones y el derecho de las víctimas a conocer la verdad de lo ocurrido en el contexto colombiano, a partir de la entrada en vigencia de la Ley 906 de 2004. Por lo tanto, la finalidad es determinar si la aplicación de esta figura niega a las víctimas el derecho a conocer la verdad, para lo cual se realizó una revisión de la doctrina nacional e internacional pertinente, con un claro enfoque cualitativo, con alcance exploratorio y descriptivo. Obteniendo como resultado que, sin lugar a dudas, este derecho de los afectados con el delito ha sido cercenado por el legislador de manera injustificada al introducir la institución en el sistema penal, razón por la cual se sugiere retomar la figura de la confesión de la legislación anterior para disminuir el impacto negativo que ha tenido.

Regarding this, the goal is to determine whether the application of this law denies the victim the right to know the truth for which a review of the applicable national and international doctrine with a clear qualitative focus and an explorative and descriptive scope would be required, obtaining as a result that without doubt this right of the victim regarding the felony has been cut out by the legislator in an injustified way by introducing its institution in the penal system which is why going back to the confession as it was done in the prior legislation is advised in order to decrease the negative impact that it has had.
