Resumen
El presente trabajo apunta a un análisis jurídico sobre la violación al debido proceso según la ley 906/2004, frente a la ley 522/1999 Código Penal Militar, con el propósito de resaltar una desigualdad jurídica de la normatividad castrense frente al Código Penal Ordinario, de acuerdo a los artículos 293 Artículo 293 de la ley 522 de 1999 y 462 norma ibídem. Del análisis de estas dos normas encontramos que en el sistema penal militar y el ordinario existe una violación al debido proceso, y al principio de igualdad, desde mi punto de vista la Ley 522 de 1999 frente a la Ley 906 de 2004, instituye una situación de desigualdad, produciendo que el procedimiento penal ordinario sea más garantista y favorable comparándolo con el procedimiento militar frente a los delitos comunes que son juzgados por la Ley 522/1999, dicha ley no contempla ningún favorabilidad para el uniformado investigado. Partiendo de las normas castrenses, no se puede ocultar la parte inquisitiva que guarda la ley 522/1999, en el entendido que el sistema penal acusatorio solo se desarrolla con la ley 1407 de 2010 nuevo código penal militar en cuanto a la parte procedimental, la cual aún no entra en vigencia, lo que a groso modo y desde lineamientos constitucionales, estas normas siguen cercenando los principios fundamentales de aplicación de justicia bajo principios de igualdad, y sobre todo con el respeto de lo normado en la constitución política según el artículo 29 que regula el debido proceso como principio fundamental.
This work points to a legal analysis about due process violation according to the Law 906/2004, versus the Law 522/1999 Military Penal Code, in order to highlight a legal inequality of military regulations versus the ordinary Penal Code, according to articles 293 and 462 ibid. From the analysis of these two Laws we found that in Military Penal System and in ordinary Penal System there is a violation of due process, and to the principle of equality, from my point of view Law 522 of 1999 versus Law 906 of 2004 establishes a situation of inequality, causing that the ordinary Penal System Procedure would be more guarantees and favorability compared to the Military Procedure against ordinary crimes that are judged by the Law 522/1999, this Law does not provide any favorability for the investigated military person. Based on military Laws, we cannot hide the inquisitive part that Law 522/1999 keeps, knowing that the Accusatory Penal System only gets development with the Law 1407/2010 new Penal Military Code on the procedural part of it, which roughly reduce the constitutional guidelines, and from these Laws are still whittled the fundamental principles of application of the Justice under the principles of equality, and the most important regarding to regulations in the Politic Constitution according to article 29 as a fundamental principle
