Abstract
Mirada a la Constitucionalidad de la Discrecionalidad en las Declaraciones de Insubsistencia de Empleados de Libre Nombramiento y Remoción. Análisis desde la Teoría del Estado Social de Derecho. La discrecionalidad administrativa como institución jurídica ha evolucionado desde su creación a partir de la revolución francesa.
En este trabajo se analiza si es constitucional o no aplicar esta figura respecto de la insubsistencia de los empleados de libre nombramiento y remoción, abordando la investigación a partir de la metodología cualitativa en la medida que se parte de un problema jurídico, pero con implicaciones sociales. Después de analizar la evolución teórica de conceptos: Discrecionalidad Administrativa, empleados de libre nombramiento y remoción y confrontar la teoría del estado social de derecho y la teoría de la Discrecionalidad Administrativa fueron encontradas inconsistencias entre los mandatos constitucionales y la discrecionalidad en este tipo de actos administrativos toda vez que se vulneran derechos constitucionales al carecer de motivación.
A Look at the Constitutionality of Discretionality in the Declarations of Insistence of Employees of Free Appointment and Removal. Analysis from the Theory of the Social State of Law. The administrative discretion as a legal institution it has evolved since the French Revolution. In this work it's analyzed whether it is constitutional or not to apply this figure regarding the Non-subsistence of the employees from free appointment and removal, approaching the investigation from the qualitative methodology in the measure than is part of a legal problem, but with social implications. After analyzing the theoretical evolution of concepts: Administrative discretion, employees from free appointment and removal and confronting the theory of the social state of law and the theory of Administrative Discretion were found inconsistencies between constitutional mandates and discretion in this type of administrative acts Whenever constitutional rights are violated as they lack motivation.
