Abstract
La objeción de conciencia con respecto al servicio militar a nivel mundial se gesta en razón de su obligatoriedad, las grandes guerras son precisamente las que han conllevado, incluso hoy en día a los estados a establecer medios de coacción con el fin de proteger o defender la patria, cada estado requiere de fuerzas militares especiales instruidas previamente para actuar en caso de eventualidades en las cuales se requiera de su experticia y conocimiento, un país armado, con capacidad táctica y personal experto se asimila a un país temido, de ahí, que dichas características se convierten en un escudo y a la vez en un contemporáneo enemigo. Pero, ¿Qué pasa con las personas que por sus creencias, opiniones, condiciones, pensamientos, valores y vivencias no quieren hacer parte de la guerra, ni prepararse para retaliaciones o ataques?, De acuerdo con el artículo 216 de la Carta Magna de 1991, la prestación del servicio militar en Colombia es un compromiso en cabeza del 100 por ciento de los hombres mayores de edad. El marco normativo general que regula la prestación del servicio militar en el país está consignado en la Ley 48 de 1993 y el Decreto 2048 del mismo año.
La libertad de conciencia es el derecho a tener en nuestro fuero íntimo cualquier idea o creencia en todo respecto, se trata de cuestiones políticas, religiosas, o de la visión filosófica del mundo y de la vida. La conciencia no puede ser invadida por los otros ni por las autoridades, En virtud de la norma constitucional comentada no se puede obligar a una persona a actuar contra su conciencia. La Constituyente no consagró de manera expresa la objeción de conciencia al servicio militar, pero estableció aquí una disposición general que da lugar a su existencia en el orden constitucional colombiano.

But, what about people who, because of their beliefs, opinions, conditions, thoughts, values and experiences, do not want to be part of the war, nor prepare themselves for retaliation or attacks?, According to Article 216 of the 1991 Constitution. , the provision of military service in Colombia is a commitment headed by 100 percent of men of legal age. The general regulatory framework that regulates the provision of military service in the country is set forth in Law 48 of 1993 and Decree 2048 of the same year.
Freedom of conscience is the right to have in our hearts any idea or belief in all respects, it is about political, religious issues, or the philosophical vision of the world and of life. The conscience can not be invaded by others or by the authorities. Under the constitutional rule commented can not force a person to act against his conscience. The Constituent Assembly did not expressly conscientious objection to military service, but established here a general provision that gives rise to its existence in the Colombian constitutional order.
