Abstract
El texto aborda el tema de las acciones afirmativas y su relación con el principio de igualdad. Presenta información estadística sobre la cantidad de afrocolombianos oficiales que han ingresado a las Fuerzas Militares y de Policía entre los años 2013 a 2017; explora la línea jurisprudencial trazada por la Corte Constitucional en relación a este tipo de acciones, resaltando las sentencias más trascendentales emitidas a favor del respeto de los derechos de los afrocolombianos; finalmente, propone algunas formas de acciones positivas, que pese a que no son novedosas para el Estado, sí lo son para el caso en particular, y pueden ser implementadas con el fin de aumentar la presencia de personal afro en todas las dignidades del Cuerpo de Oficiales de la institución, implicando necesariamente, una reforma o adición a los Decretos 1790 y 1791 de 2000, los cuales regulan la carrera del personal de oficiales y suboficiales de las Fuerzas Militares, y del personal de Oficiales, Nivel Ejecutivo, Suboficiales y Agentes de la Policía Nacional. Para los fines correspondientes, este documento se desarrolla según el método lógico de investigación o análisis del derecho en contexto, el hermenéutico y el experimental.
The text addresses the theme of affirmative action and its bond with the principle of equality. This text presents statistical information with regards to the official amount of Afro-Colombians who have entered the military and police forces between the years of 2013 and 2017; It explores the jurisprudential line established by the constitutional court concerning these kinds of facts and points out the most significant sentencing issue in favor of the rights of Afro-Colombians; Eventually, it proposes several forms of positive actions, however for the state these are not new enough, these are for a particular case in which they could be implemented in order to increase the presence of Afro-staff, in all the positions of the Officers Corps of the institution, this necessarily implies, a reform or addition to Decrees 1790 and 1791 of 2000, those that regulate the course/career of the officers and non-commissioned officers’ staff belonging to the military forces and the staff of officers, executive level, non-commissioned officers and National police officers. For the corresponding purposes, this document is developed according to the logical method of investigation or analysis of law in context, hermeneutical and experimental.
