Abstract
El presente artículo pretende indagar sobre el grado de responsabilidad del comandante frente a delitos cometidos por militares bajo su mando en el desarrollo de operaciones militares, conforme con el avance de instrumentos internacionales, la doctrina y los casos que incumben al derecho de Ginebra y el derecho de La Haya; por consiguiente conceptos como mando, subordinación, cadena de mando, estructura, control efectivo, se deben analizar para que se dé un adecuado juicio de valor de la conducta, de la imputación y la responsabilidad.
Se propone, examinar las teorías que se han decantado en el mundo contemporáneo para reflexionar si estas solucionan o precisan los criterios de imputación en la cadena de mando y determinar si la responsabilidad se agota en el más alto nivel del ejercicio del mando, a partir del control efectivo o por el contrario si ella se deduce y disipa en los diferentes escalones del mando conforme el grado de participación en la conducta punible.
This article aims to investigate the degree of responsibility of the commander against crimes committed by military under his command in the development of military operations, in accordance with the progress of international instruments, doctrine and cases that fall under the law of Geneva and the right The Hague, therefore concepts such as command, subordination, chain of command, structure, effective control, must be analyzed so that an appropriate value judgment of the conduct, of the imputation and responsibility is given.
It is proposed to examine the theories that have been chosen in the contemporary world to reflect whether these solve or specify the criteria of imputation in the chain of command and determine if responsibility is exhausted at the highest level of the exercise of command, starting from effective control or on the contrary if it is deduced and dissipated in the different steps of the command according to the degree of participation in the punishable conduct
