Abstract
La función de control, inspección y vigilancia en el servicio público de la educación superior debe regularse dentro de un marco jurídico con conceptos y procedimientos administrativos y sancionatorios claros, acordes con los principios de legalidad y debido proceso, para el correcto ejercicio de estas funciones, máxime cuando la administración hace uso de estos mecanismos de intervención que en la práctica ponen en riesgo el principio de la autonomía universitaria. Lo anterior, atendiendo a que el Ministerio de Educación Nacional en uso de las facultades establecidas en la Ley 1740 de 2014 por medio de la cual se regula la inspección y vigilancia en la educación superior, puede llegar a desbordar o extralimitarse en sus funciones, ya que esta normatividad más que dotar y ampliar los mecanismos al Ministerio para el ejercicio de estas atribuciones, resulta ser un instrumento de carácter restrictivo y policivo para las instituciones de educación superior; no obstante, que la Constitución Política y la Ley 30 de 1992 que organiza este servicio público, propende por la armonización entre las facultades de regulación y la autonomía universitaria.
The function of control, inspection and monitoring in the public service of higher education must be regulated within a legal framework with clear administrative and sanctioning concepts and procedures, in accordance with the principles of legality and due process, for the proper exercise of these functions, especially when the administration makes use of these intervention mechanisms that in practice put at risk the principle of university autonomy. The foregoing, considering that the Ministry of National Education in use of the faculties established in Law 1740 of 2014 by means of which the inspection and surveillance in higher education is regulated, may overflow or overreach in its functions, due to that this regulation, rather than endowing and expanding the mechanisms to the Ministry for the exercise of these powers, turns out to be an instrument of a restrictive and policing nature for higher education institutions; notwithstanding that the Political Constitution and the Law 30 of 1992 that organizes this public service, tends for the harmonization between the faculties of regulation and the university autonomy
