Abstract
La cartelización empresarial es un delito asociado a la corrupción, por medio del cual algunas empresas se alían afectando la libre competencia. A través del material recopilado y analizado, se identificaron algunos de los casos más recientes tanto en Colombia como en España, haciendo énfasis en los carteles de pañales en ambos países, con el fin de determinar sus principales características, personas involucradas, acuerdos establecidos y duración del delito. Adicionalmente, se estableció el papel desempeñado por los entes de vigilancia y control, las investigaciones adelantadas y las sanciones impuestas dentro del marco legal vigente, todo lo anterior, con el fin de servir de material de estudio para identificar, prevenir y actuar oportunamente, ante nuevos posibles casos.
The cartelization of what should be a legitimate enterprise, is a crime against the principle of free competition among like Companies.
The following material intends to analyse the most recent case of this criminal behavior, both in Colombia and Spain. Emphasis of this material will be placed on the "Diaper Cartel", as it took place in these two countries. We attempt to identify the characteristics of the scheme, the perpetrators involved, the agreements plotted, as well as the duration of that activity, and, how that conspiracy was unveiled with the proper surveillance. The sanctions imposed by the respective countries will be presented together with the measures taken to prevent future similar activities.
