Abstract
El presente artículo abordará el análisis de las ejecuciones extrajudiciales frente a los delitos que se traducen en el sistema penal por parte de miembros de las Fuerzas Militares. En este sentido, se emprenderá una revisión a partir de las garantías procesales tendientes a valorar el acceso a la administración de justicia. Con ello se pretende resolver uno de los interrogantes entorno al tipo sanciones jurídicas a imponer frente a graves violaciones a los derechos humanos. Todo ello a partir de lo esbozado en la jurisprudencia nacional e internacional con el fin de realizar un examen jurídico de las acciones llevadas a cabo por agentes estatales de la fuerza pública, debido al conflicto armado, junto con el grado de responsabilidad de la institución y el Estado.
This article will deal with the analysis of extrajudicial executions against crimes that are translated into the penal system by members of the Armed Forces. In this sense, a review will be undertaken based on the procedural guarantees aimed at assessing access to the administration of justice. This is intended to solve one of the questions surrounding the type of legal sanctions to be imposed in the face of serious human rights violations. All this from what was outlined in the national and international jurisprudence in order to carry out a legal examination of the actions carried out by state agents of the public force, due to the armed conflict, together with the degree of responsibility of the institution and the state.
