Abstract
Del análisis realizado a la Carta Política, leyes, actos legislativos, directivas y jurisprudencia de la Corte Constitucional, Corte Interamericana de Derechos Humanos y Tribunales Internacionales; se evidenció la afectación de los derechos de las víctimas en sus cuatro expresiones: verdad, justicia, reparación y garantías de no repetición; en el marco de un proceso de justicia transicional al entran en conflicto intereses yuxtapuestos, los derechos de las víctimas, quienes reclaman el derecho a la verdad, justicia, reparación y garantías de no repetición y frente aplicación de instrumentos de justicia transicional tales como la selección y la priorización, lo que implica la renuncia tácita a la acción penal. Situación que genera efectos negativos en términos de garantía y respeto de los derechos de las víctimas, a la luz de estándares internacionales de justiciabilidad.
El presente artículo se fundamentará bajo una perspectiva funcionalista y consultas de carácter bibliográfico, con base a lo planteado siendo por Carlos R, el cuales un referente teórico de lo planteado en materia de selección y priorización.
La respuesta a la pregunta de investigación surgió a partir del estudio de la ruptura entre la aplicación de criterios, selección, priorización y la afectación a las víctimas; siendo el objeto jurídico de la presente investigación. Este análisis permitió establecer que resulta pertinente la creación de mecanismos jurídicos que garanticen una paz estable y duradera, como también se respeten los derechos de las víctimas, la cual es una de las aplicaciones que tiene como instrumentos la Ley Justicia Transicional, siendo una clave importante en los derechos jurídicos.
From the analysis made to the Political Charter, laws, legislative acts, directives and jurisprudence of the Constitutional Court, Inter-American Court of Human Rights and International Tribunals; it was evident the affectation of the rights of the victims in its four expressions: truth, justice, reparation and guarantees of non-repetition; within the framework of a process of transitional justice when juxtaposed interests come into conflict, the rights of the victims, who claim the right to truth, justice, reparation and guarantees of non-repetition and against the application of instruments of transitional justice such as the selection and prioritization, which implies the tacit waiver of criminal action. Situation that generates negative effects in terms of guarantee and respect for the rights of the victims, in light of international standards of justiciability.
This article will be based on a functionalist perspective and bibliographic queries, based on what was proposed by Carlos R, which is a theoretical reference of the issues raised in terms of selection and prioritization.
The answer to the research question arose from the study of the rupture between the application of criteria, selection, prioritization and the affectation to the victims; being the legal object of the present investigation. This analysis made it possible to establish that it is pertinent to create legal mechanisms that guarantee a stable and lasting peace, as well as to respect the rights of the victims, which is one of the applications that the Transitional Justice Law has as instruments, being an important key in legal rights.
