Resumen
La justicia colombiana pasa por uno de los periodos más críticos de su historia, el mal momento se debe, a una percepción de injusticia, sobre todo, la falta de confianza y de legitimidad que se tiene en la operatividad judicial. Prima facie, el esfuerzo decoroso de instituciones, juristas y académicos del país, quedarían opacados ante conductas patológicas que hoy tienen al Derecho Procesal Penal en sala de cuidados intensivos.Por consiguiente, desde la óptica de Adorno y Horkheimer expresada a través de la “dialéctica de la Ilustración” éste artículo, analizá la mala conducta que permea los Preacuerdos y Negociaciones del Derecho Procesal Penal. Pretendiendo rescatar el Aprestigio como principio ético fundante de justicia, seguridad y convivencia social.
Colombian justice goes through one of the most critical periods of its history, the bad moment is due to a perception of injustice, especially the lack of confidence and legitimacy that is in the judicial operation. Prima facie, the decorous effort of institutions, jurists and academics in the country, would be overshadowed by pathological behaviors that today have criminal procedural law in the intensive care room. Therefore, from the point of view of Adorno and Horkheimer expressed through the "dialectic of the illustration" this article analyzes the misconduct that permeates the Pre- agreements and Negotiations of Criminal Procedural Law. Pretending to rescue aprestige as a fundamental ethical principle of justice, security and social coexistence.
