Resumen
El postmodernismo trae consigo nuevos desafíos para el derecho procesal penal. Al punto, que delitos contra la libertad, integridad y formación sexuales, generan un limitante para el imputado, toda vez que la presunción de inocencia se ve amenazada al momento de valorar la prueba testimonial de presuntas víctimas (niños, niñas y adolescentes). Prima facie, el síndrome de alienación parental suele usarse para equilibrar la balanza en favor del ente acusador, cuando a través de conductas manipulativas de uno de los custodios del menor, se pretende anteponer intereses revanchistas. Dado lo anterior, el artículo, describirá las consecuencias nefastas que acarrea el quebrantamiento de imparcialidad cuando se juzgan las conductas punibles referenciadas ut supra.
Postmodernism brings with it new challenges for criminal procedural law.
