Abstract
La carga dinámica de la prueba, es adoptada legalmente por primera vez en el Código General del Proceso, como una alternativa que tiene el operador judicial, quedando facultado así para variar las cargas probatorias a la parte que él considere se encuentre en mejores condiciones de probar, respecto de un determinado hecho, con el propósito de garantizar un mejor equilibrio procesal y en el mismo, dar un gran avance enfocado a contribuir a la solidaridad con las partes más débiles en un litigio. Es así como el juez en el desarrollo de dicha labor, debe aplicar criterios de proporcionalidad y razonabilidad para lograr determinar la necesidad y justificar de manera adecuada la decisión de invertir la carga de la prueba, que de no ser así estaría generando un desequilibrio entre las partes. Este escrito tiene como propósito principal analizar la proporcionalidad y razonabilidad que debe aplicar el juez al momento de realizar la inversión de la carga de la prueba, con el objetivo de determinar si dichos criterios serían el límite de la discrecionalidad del operador judicial para ejercer dicho deber legar, o por el contrario, podría ser una labor plenamente subjetiva, la cual llegaría a considerarse como una decisión arbitraria.
The dynamic load of the test, is legally adopted for the first time in the General Code of the Process, as an alternative that has the judicial operator, being thus authorized to vary the evidentiary burdens to the party that he considers to be in a better condition to prove, regarding a certain event, with the purpose of guaranteeing a better procedural balance and in the same, to give a great advance focused on contributing to the solidarity with the weakest parties in a litigation. This is how the judge in the development of such work, must apply criteria of proportionality and reasonableness to determine the need and adequately justify the decision to reverse the burden of proof, which otherwise would be generating an imbalance to the parts. The main purpose of this writing is to analyze the proportionality and reasonableness that the judge must apply when making the investment of the burden of proof, with the aim of determining if said criteria would be the limit of the discretion of the judicial operator to exercise said duty. bequeath, or on the contrary, it could be a fully subjective task, which would come to be considered as an arbitrary decision.
