Resumen
En términos generales, se pretende dar respuesta al interrogante: ¿Cuáles son las principales causas tributarias de quiebre de las pymes en Colombia? En este sentido se abordará en primer lugar la situación actual de la empresa colombiana en términos de fracaso organizacional o no continuidad analizando las principales causas de ocurrencia desde una perspectiva administrativa y contable. En segundo lugar, se analizará la relación entre la carga tributaria y el cierre de las PYMES haciendo énfasis en el impacto de la actual reforma tributaria Ley 1819 de 2016 en las PYMES y los tipos de impuestos que deben pagar éstas en Colombia. En tercer lugar se retoma a la luz de la entrada en vigencia de la Ley 1819 del 2016 la incidencia de los incentivos tributarios estatales en la sostenibilidad de las PYME analizando los incentivos tributarios para las empresas que participen en el posconflicto, los beneficios tributarios para PYMES del sector de las TIC y los beneficios tributarios paras las PYMES en las zonas francas terminando en cuarto lugar con una consideración final acerca de la importancia de la planeación tributaria en el contexto de la sostenibilidad organizacional lo mismo que del rol del contador público como asesor fiscal tanto en los procesos de planeación tributaria como en los procesos operativos del pago de impuestos.
Generally, one tries to give answer to the question: What are the main tributary causes of rupture of the SMEs in Colombia? In this sense there will be tackled firstly the current situation of the Colombian company in terms of organizational defeat or not continuity analyzing the main causes of occurrence from an administrative and countable perspective. Secondly the relation will be analyzed between the tributary load and the closing of the SMEs doing emphasis on the impact of the current tributary reform Law 1819 of 2016 in the SMEs and the types of taxes that these must pay in Colombia. In the third place there is recaptured in view of the entry into force of the Law 1819 of 2016 the incidence of the state tributary incentives in the sustainability of the SMEs analyzing the tributary incentives for the companies that take part in the Post-conflict, the tributary benefits for SMEs of the sector of the TIC and the tributary benefits for the SMEs in the free zones finishing in the fourth place with a final consideration about the importance of the “Tax planning” in the context of the organizational sustainability the same that of the roll of the public book-keeper like tax consultant so much in the planning processes it would pay as in the operative processes of the payment of taxes.
